Terms of Use

These Terms of Use ("Terms") govern your use of the Complexion Beauty mobile application ("App") operated by CullWell Technologies, LLC ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To access certain features, you must create an account using a valid email address or a third-party sign-in service (Google or Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Description of Service

Complexion Beauty is a free beauty management application that provides:

• Personalized beauty assessments and skincare plans
• Product collection tracking, including usage frequency and expiration dates
• Morning and evening skincare routine management
• Lexi, an AI-powered beauty assistant for personalized recommendations
• Skin diary with selfie progress tracking
• Product discovery through barcode scanning and photo recognition
• Beauty article and video recommendations
• Product price comparison and affiliate shopping links
• Push notification reminders for routines, replenishment, and product expiration

The App is provided free of charge. We earn revenue through affiliate commissions when you purchase products through links in the App.

4. AI Assistant Disclaimer

Lexi, our AI beauty assistant, is powered by third-party artificial intelligence technology (Anthropic Claude). While we strive to provide helpful and accurate beauty recommendations:

• Lexi is not a medical professional. Recommendations provided by Lexi are for informational and entertainment purposes only and do not constitute medical, dermatological, or professional skincare advice.
• You should consult a qualified dermatologist or healthcare provider before making changes to your skincare routine, especially if you have existing skin conditions, allergies, or sensitivities.
• AI recommendations may be inaccurate. While Lexi uses your beauty profile and product data to personalize responses, AI-generated content may contain errors or may not be suitable for your specific situation.
• Ingredient analysis is informational only. Our ingredient safety ratings and conflict detection features are based on publicly available data and are not a substitute for professional evaluation.

5. Skin Diary and Selfie Photos

The skin diary feature allows you to take selfie photos to track your skin progress over time. By using this feature:

• You consent to the App accessing your device camera for the purpose of capturing selfie photos.
• Photos are stored securely in your private account and are not shared with other users or third parties (except as necessary for cloud storage via Firebase).
• Photos are processed on your device for face detection and cropping purposes only.
• You may delete individual skin diary entries or all skin diary data at any time through the App.

6. Product Information and Pricing

• Product information displayed in the App is retrieved from third-party databases and may not always be accurate, complete, or up to date.
• Prices displayed through the price comparison feature are retrieved from third-party sources and may differ from actual prices at the time of purchase.
• We do not guarantee the accuracy of product ingredients, safety ratings, or pricing data.
• We are not responsible for products purchased through affiliate links. All purchases are transactions between you and the respective retailer, subject to that retailer's terms and policies.

7. Affiliate Links and Third-Party Services

The App contains affiliate links to third-party retailers. When you click an affiliate link and make a purchase, we may receive a commission from the retailer. This does not affect the price you pay.

We are not responsible for the content, privacy practices, or terms of any third-party websites or services linked within the App. Your use of third-party services is at your own risk and subject to those services' terms and policies.

8. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to the App, other user accounts, or our systems
• Upload or transmit viruses, malware, or other harmful code through the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to harass, abuse, or harm other persons
• Use automated systems or software to extract data from the App (scraping)
• Circumvent, disable, or interfere with security features of the App
• Misrepresent your identity or impersonate any person
• Use the App to upload content that is illegal, offensive, or infringes on the rights of others

9. Intellectual Property

The App and its original content, features, and functionality are owned by CullWell Technologies, LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

"Complexion Beauty," "Complexion," "Lexi," the Complexion Beauty logo, and the feminine face design are trademarks of CullWell Technologies, LLC. You may not use our trademarks without prior written consent.

10. User-Generated Content

By submitting content to the App (including product reviews, skin diary notes, and chat messages with Lexi), you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content for the purpose of providing and improving the App's services.

You retain ownership of any content you submit. We will not use your content for marketing or advertising purposes without your explicit consent.

11. Account Deletion

You may delete your account at any time through the Settings screen in the App. Upon account deletion:

• All personal data, beauty profiles, product collections, routines, skin diary entries (including photos), and chat history will be permanently deleted from our servers.
• This action is irreversible and cannot be undone.
• Deletion will be processed within 30 days, though data may persist in encrypted backups for up to 90 days before being purged.
• Account deletion does not affect any purchases you have already made through affiliate links with third-party retailers.

12. Push Notifications

The App may send push notifications for routine reminders, product expiration alerts, replenishment reminders, and feature updates. You can manage or disable push notifications at any time through the App's Settings screen or your device's notification settings.

13. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE APP, INCLUDING BUT NOT LIMITED TO PRODUCT INFORMATION, INGREDIENT ANALYSIS, AI RECOMMENDATIONS, AND PRICING DATA.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CULLWELL TECHNOLOGIES, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ACCESSED THROUGH THE APP
• ANY CONTENT OBTAINED FROM THE APP, INCLUDING AI-GENERATED RECOMMENDATIONS
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA
• ADVERSE SKIN REACTIONS OR HEALTH EFFECTS RESULTING FROM FOLLOWING RECOMMENDATIONS PROVIDED BY THE APP OR LEXI
• PURCHASES MADE THROUGH AFFILIATE LINKS IN THE APP

15. Indemnification

You agree to indemnify, defend, and hold harmless CullWell Technologies, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the Commonwealth of Kentucky. You agree to waive any right to a jury trial or to participate in a class action.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of these Terms and, for significant changes, by providing notice through the App. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CullWell Technologies, LLC regarding your use of the App, superseding any prior agreements.
